1. Acceptance of Terms
By accessing or using the Chyna platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform. These Terms constitute a legally binding agreement between you and Chyna (Pty) Ltd.
You must be 18 years or older and a resident of South Africa to use our services.
2. Nature of Our Service
Chyna is a digital health platform that facilitates connections between patients and independent, licensed HPCSA-registered medical practitioners. Chyna is not a medical provider. We do not employ doctors, and no doctor-patient relationship exists between you and Chyna.
The medical consultations, diagnoses, and prescriptions are conducted exclusively by independent licensed practitioners. Chyna provides the technology platform that enables these interactions.
3. Medical Disclaimer
The information provided on this Platform is for general informational purposes only and does not constitute medical advice. Always follow the instructions of your treating doctor. If you are experiencing a medical emergency, call 10177 or your nearest emergency service immediately.
Our services are not suitable for emergency or urgent medical situations. If you are in distress, please contact emergency services.
4. Eligibility & Account
To use our services, you must:
- Be 18 years of age or older
- Be a resident of South Africa
- Provide accurate, complete, and up-to-date information in your health assessment
- Have a valid South African ID or passport
You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately if you suspect unauthorised access to your account.
5. Consultations & Prescriptions
Consultations are conducted by independent HPCSA-registered medical practitioners. The doctor may decline to prescribe medication if, in their clinical judgement, it is not appropriate for you. A prescription does not guarantee that medication will be dispensed — this remains the discretion of the treating doctor and dispensing pharmacist.
All medications dispensed are SAHPRA-approved and require a valid prescription issued by a licensed South African doctor.
6. Payments & Refunds
Consultation fees are charged at the time of booking. The consultation fee reflects the licensed medical practitioner's professional time and clinical evaluation, and is strictly non-refundable in all of the following circumstances:
- The doctor reviews your case and determines that treatment is not clinically appropriate, and therefore does not issue a prescription.
- You do not attend, miss, or are not available for the consultation time you booked.
- The consultation has commenced (whether by call, video, or asynchronous review).
- You decide not to proceed with the treatment after the consultation, or do not pay for a prescribed medication.
- You provided incorrect, incomplete, or misleading information in your questionnaire that affected the doctor's evaluation.
By paying the consultation fee, you acknowledge and accept that you are paying for a medical evaluation, not a guaranteed treatment outcome. Treatment is at the sole discretion of the licensed medical practitioner.
Medication fees are charged separately only after a prescription has been issued and you elect to proceed. Once medication has been dispensed and shipped, medication payments are non-refundable. Refunds for medication damaged in transit or never delivered are subject to the dispensing pharmacy's policy and applicable South African consumer law.
7. Delivery
We aim to deliver medication within 3–5 business days across South Africa. Delivery timelines may vary based on location and courier availability. Chyna is not liable for delays caused by third-party courier services. Medications will only be delivered to the address provided at checkout.
8. Prohibited Use
You may not use the Platform to:
- Provide false or misleading health information
- Obtain medication for use by another person without a valid prescription for that person
- Circumvent any clinical or regulatory safeguards
- Resell or redistribute prescription medication
- Use the Platform for any unlawful purpose
9. Limitation of Liability
To the maximum extent permitted by South African law, Chyna shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform or the medical services provided by independent practitioners. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts. Before pursuing formal legal action, both parties agree to attempt to resolve disputes through good-faith negotiation.
11. Changes to Terms
We reserve the right to update these Terms at any time. Material changes will be communicated via email or prominent notice on the Platform. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
